CA Superior Court Finds Red Light Camera Evidence Inadmissible

The Truth About Cars reports on a decision of the California Superior Court, Appellate Division, in Orange County tossed out a red light camera citation in the city of Santa Ana in a manner that may effect redlight camera prosecutions throughout the State.

In California v. Khaled (Orange County, California Superior Court, 5/25/2010) the Court held that red light camera evidence lacks proper foundation for admissibility unless the persons that enter the time, date and other information into the camera-computer system; those that maintained the system, and the custodian of records for the photographs and other information, testify to the manner of entry, use and maintenance of the information and are subject to cross-examination.
